Clearance: does exactly what it says on the tin

Thanks to the well-known advertising slogan, regardless of our usual aptitude for domestic DIY, when it comes to buying a particular brand of British wood dye preservative we’re well trained in where to look so as to manage our expectations as to the product’s scope and limitations.

In my experience, the same is not always true for pension scheme trustees and employers, whose expectations of clearance statements from the Pensions Regulator can go far beyond what it says on the tin (that’s to say, the underlying law and guidance).

Trustees, administrators and the blame game

US President Harry S Truman famously had a sign on his desk reading “The buck stops here”, to show he took personal responsibility for the way the country was governed.*

When something goes wrong in a pension scheme and a member complains, we’re often asked where  (according to the Pensions Ombudsman) the buck will stop.  Perhaps it’s a sign of the times that, with more pension schemes outsourcing their administration to third party providers, those administrators seem to be coming in for more flak from the Ombudsman these days.

Executive ’sacked for being green’ – are lifestyle choices protected by law? The decision

I posted a piece last month on the case brought by Tim Nicholson following his dismissal by Grainger plc. He is claiming unlawful discrimination on the grounds of his philosophical belief about climate change and the lifestyle needed to avoid environmental catastrophe. The Employment Appeal Tribunal has now ruled in his favour on the question of whether his belief is within the protection of the 2003 Employment Equality (Religion or Belief) Regulations. It is – so he can pursue his tribunal claim against the company.

2012: auto-enrolment…and the end of the world?

The world’s going to end in 2012.  Sorry to ruin your day. 

So says the Hollywood blockbuster 2012 released this Friday (I should be on commission) which foretells doomsday coinciding with the end of the ancient Mayan calendar. 

Another theory – could it be a cataclysmic by-product of the introduction of pension scheme auto-enrolment in 2012?
